Resumen: | A existência humana sempre foi permeada por um constante conflito de pretensões, dentre as quais destaca-se o choque entre o individual e o coletivo. Neste ponto, as pretensões individuais da privacidade e liberdade encontram na segurança pública um de seus principais obstáculos, o qual foi galvanizado através das evoluções tecnológicas surgidas, em especial com o advento da internet e tecnologias da informação, as quais vieram a modificar radicalmente a vida em sociedade. O problema que se coloca, então, é sintetizado no tema do presente estudo: a vigilância estatal em massa e o embate de pretensões individuais e coletivas na perspectiva atual e global. Os objetivos da presente dissertação são, desta forma: averiguar se de fato existe um conflito de pretensões entre o individual e o coletivo decorrente da operacionalização da vigilância estatal em massa e, em caso positivo, como tal conflito é visualizado ao redor do globo. Para tanto o presente estudo se orienta em seu primeiro capítulo sobre aspectos históricos, filosóficos e sociais sobre o tema. No segundo capítulo são explorados os elementos técnicos do tema, analisando, ainda, a evolução histórica da vigilância. Em continuidade, o terceiro e quarto capítulos procuram observar como o tema é tratado, sob a óptica do Direito, em países do hemisfério norte e sul, respectivamente, apontando as principais características de tal prática, dispendendo atenção especial para a avaliação do tema em território brasileiro. Diante da comprovação da hipótese aventada, o quinto e último capítulo procura expedir sugestões para a melhor conformação de ambas as pretensões, valendo-se tanto de soluções de âmbito doméstico, como extraídas de modelos internacionais, buscando enfrentar o problema com hipóteses que se complementam e procuram retirar os pontos positivos de todo o estudado, procurando, com isto, realizar a conformação entre ambas as pretensões para a saúde do sistema democrático. |
Abstract : | Human existence has always been permeated by a constant conflict of pretensions, among which stands out the clash between the individual and the collective. At this point, the individual claims of privacy and freedom face public security as one of their main obstacles, which has been galvanized through technological developments, in particular with the advent of the internet and information technologies, which have radically changed life. in society. The problem that arises, then, is summarized in the theme of the present study: mass state surveillance and the clash of individual and collective claims in the current and global perspective. The objectives of the present dissertation are, thus, to ascertain whether there is in fact a conflict of claims between the individual and the collective resulting from the operationalization of mass state surveillance and, if so, how such conflict is viewed around the globe. Therefore, the present dissertation begins its first chapter studying historical, philosophical and social aspects on the subject. The second chapter explores the technical elements of the theme, analyzing also the historical evolution of the surveillance. In continuity, the third and fourth chapters try to observe how the theme is treated, from the perspective of the Law, in countries of the northern and southern hemisphere, respectively, pointing out the main characteristics of such practice, paying special attention to the evolution of the theme in the Brazilian territory. Given the confirmation of the hypothesis raised, the fifth and final chapter seeks to issue suggestions for the best conformation of both claims, drawing on both domestic and international solutions, seeking to address the problem with complementary hypotheses that seek to remove the positive points of all the studied, trying, therefore, to make the suiting between both claims for the health of the democratic system. |
