Desafios à liberdade de expressão e ao direito de informação a serem enfrentados no ambiente digital : uma visão contemporânea a partir do direito internacional dos direitos humanos

Abstract

The right to freedom of expression and the right to information are recognized as universal human rights, protected by International Public Law, but also by the Federal Constitution in the Brazilian legal system. The emergence of the Internet and its rapid evolution changed the way people communicate, expanding access to information and enhancing speeches and, consequently, the damage caused by excesses of freedom of expression when they collide with the rights of third parties that are also legally protected. The dissemination of Fake News and the spread of hate speech in the digital environment are growing concerns for international organizations and States, which are looking for a way to combat them efficiently without, however, attacking freedom of expression or restricting access to users to information. This research will seek to take an approach based on International Human Rights Law on the challenges to freedom of expression and the Right to information in the digital environment. The work will answer the following problem: what are the main challenges to freedom of expression and the right to information in the digital environment? The choice of the theme occurs due to the relevance of the extremely current issue and related to the moment the country and the world are going through, in which the Internet has started to play a decisive role in global political decisions. The general objective of the research is to list the challenges to freedom of expression and the right to information in the digital environment, to this end it will have the following specific objectives: demonstrate that the Right to freedom of expression and the Right to information are fundamental Human Rights; present the main aspects of the digital environment; analyze the biggest challenges to freedom of expression and the right to information in the digital environment. This is qualitative research that aims to deepen the topic studied by analyzing relevant publications in the legal area; It will be an exploratory type of research. The techniques used will consist of a bibliographic review on the subject.
