| Abstract: | A presente Tese tem como objetivo discutir Instrumentos Nacionais e Internacionais para conservação e uso sustentável da diversidade biológica do Bioma Mata Atlântica e da Zona Costeira no Município de Bertioga. Para tanto, avalia-se bioma mata atlântica, sua proteção nacional e internacional e outras proteções institucionais, conciliando a análise aos objetivos de desenvolvimento sustentável constantes na agenda 2030 da ONU. Neste contexto, é analisado o papel dos novos atores da sociedade internacional e seu papel na proteção de referido bioma, para finalmente avaliar as iniciativas e possíveis ações em prol da mata atlântica no Município de Bertioga/SP. Assim, se questiona como é possível conciliar o desenvolvimento econômico nestas regiões, a partir de um planejamento estratégico, conciliando a participação do Poder Público e da Iniciativa Privada? A partir dos Objetivos de Desenvolvimento Sustentável da ONU, na agenda 2030, qual o conceito de desenvolvimento sustentável, e como é possível viabilizar a proposta global na Região do Litoral Paulista, em especial no Município de Bertioga? Qual o papel dos atores subnacionais, na efetivação das metas globais de desenvolvimento sustentável? Como a implantação de um Plano Municipal de Conservação e Recuperação da Mata Atlântica (PMMA), pode garantir um planejamento para uma organização eficaz do zoneamento urbano e uma definição clara das áreas essenciais para preservação da mata atlântica? A partir do PPMA, como garantir a desocupação destas áreas, em especial, com a participação do Poder Público e da Iniciativa Privada? Como os meios alternativos de solução de conflitos, em especial a Mediação, podem representar uma alternativa à judicialização, e garantir a efetividade no processo de Preservação Ambiental e regularização fundiária? Através de um processo Institucional de Mediação Ambiental, quais desafios a serem superados, para sua efetiva aplicação? Neste contexto, como garantir, a partir dos instrumentos propostos a preservação das áreas de Mata Atlântica inseridas na Zona Costeira, também atingidas por ocupações? Para a elaboração do trabalho ensejado utiliza-se o método de abordagem hipotético dedutivo, sendo as seguintes hipóteses testadas a partir dos questionamentos propostos: A partir de um planejamento estratégico, é possível conciliar o desenvolvimento econômico nestas regiões, com a participação do Poder Público e da Iniciativa Privada, dialogando, a partir dos preceitos da mediação, e mesmo assim garantir a preservação do bioma predominante na Região que é a Mata Atlântica. A partir dos Objetivos de Desenvolvimento Sustentável da ONU, na agenda 2030, em especial os ODS 11, meta 11.6 e ODS 15, meta 15.2., a proposta buscará conciliar o desenvolvimento econômico sustentável, e ainda a recuperação de áreas ocupadas do bioma Mata Atlântica na Região do Litoral Paulista, em especial no Município de Bertioga, definindo, enfim, o papel dos atores subnacionais relevantes à proposta, na efetivação das metas globais de desenvolvimento sustentável. O procedimento técnico utilizado é o da documentação indireta, realizando pesquisas bibliográficas com base nos principais doutrinadores nacionais e estrangeiros do tema e coletando dados documentais fornecidos por empresas e órgãos públicos nas mais variadas esferas. Finalmente, a partir do estudo dos instrumentos propostos, dentre eles a mediação, é avaliado, a partir dos resultados identificados, como este instrumento pode viabilizar o desenvolvimento econômico sustentável da região, bem como a recuperação e preservação do Bioma Mata Atlântica. |
| Abstract: | This Thesis aims to discuss National and International Instruments for the conservation and sustainable use of the biological diversity of the Atlantic Forest Biome and the Coastal Zone in the Municipality of Bertioga. To this end, the Atlantic Forest biome, its national and international protection and other institutional protections are evaluated, reconciling the analysis with the sustainable development objectives contained in the UN 2030 agenda. In this context, the role of new actors in international society and their role in the protection of that biome is analyzed, to finally evaluate the initiatives and possible actions in favor of the Atlantic Forest in the Municipality of Bertioga/SP. Thus, the question is how is it possible to reconcile economic development in these regions, based on strategic planning, reconciling the participation of the Public Power and the Private Initiative? Based on the UN Sustainable Development Goals, in the 2030 agenda, what is the concept of sustainable development, and how is it possible to make the global proposal viable in the Coastal Region of São Paulo, especially in the Municipality of Bertioga? What is the role of subnational actors in achieving global sustainable development goals? How can the implementation of a Municipal Plan for the Conservation and Recovery of the Atlantic Forest (PMMA) guarantee planning for an effective organization of urban zoning and a clear definition of essential areas for the preservation of the Atlantic Forest? Based on the PPMA, how can we guarantee the eviction of these areas, especially with the participation of the Public Power and the Private Initiative? How alternative can means of conflict resolution, in particular Mediation, represent an alternative to judicialization, and guarantee effectiveness in the process of Environmental Preservation and land regularization? Through an Institutional process of Environmental Mediation, what are the challenges to be overcome for its effective application? In this context, how to guarantee, from the proposed instruments, the preservation of the Atlantic Forest areas inserted in the Coastal Zone, also affected by occupations? For the elaboration of the work, the hypothetical deductive method of approach is used, with the following hypotheses being tested from the proposed questions: From a strategic planning, it is possible to reconcile the economic development in these regions, with the participation of the Public Power and the Private Initiative, dialoguing, from the precepts of mediation, and even so guarantee the preservation of the predominant biome in the Region that is the Atlantic forest. Based on the UN Sustainable Development Goals, in the 2030 agenda, in particular SDGs 11, target 11.6 and SDGs 15, target 15.2, the proposal will seek to reconcile sustainable economic development, as well as the recovery of occupied areas of the Atlantic Forest biome in the Coastal Region of São Paulo, especially in the Municipality of Bertioga, finally defining, the role of subnational actors relevant to the proposal, in the realization of the global goals of sustainable development. The technical procedure used is that of indirect documentation, carrying out bibliographic research based on the main national and foreign scholars on the subject and collecting documentary data provided by companies and public bodies in the most varied spheres. Finally, from the study of the proposed instruments, including mediation, it is evaluated, from the identified results, how this instrument can enable the sustainable economic development of the region, as well as the recovery and preservation of the Atlantic Forest Biome. |
