Abstract

This research proposes an understanding of technical issues related to the structure of legal norms regarding the management of urban solid residues, under national legislation and the legislation in the city of São Vicente (SP). A question of solid residues generated in the urban areas is currently on of the main themes in debate, in special in the municipal administration scenario. Most of Brazilian cities do not have a model to deal with and to manage the disposal of solid residues, and thus it is carried out without any planning regarding the customary operations. This research explores technical aspects related to the structure of legal rules of the management of solid residues in São Vicente (SP), comparing local and national legislation. Preventive reflexes of the legal rules are also evaluated, as this focus is as relevant as both their retributive and repressive effects, since environmental damages, once it has occurred, cannot be reversed. Therefore, this is why the management of solid residues has relevance in preventing environmental damage. Therefore, it was investigated what would be the relationship between, on the one hand, the production of a legal norm on the federal sphere, and on the other hand, the respective local norms regarding the management of solid waste in the municipal territory. To produce this research, a qualitative study was carried out, by means of a systematic bibliographic review, using articles and books published nationally and internationally. In addition, the hypothetical-deductive method was used.
