Abstract

This dissertation examines the complexity of international criminal justice from its historical roots to the establishment of the International Criminal Court (ICC). The study deepens the understanding of the rights and guarantees of those processed by the ICC, assessing the practical application of these principles. It is proposed that the ICC aligns the rights and guarantees of the accused with universally recognized criminal law principles of Democratic States and International Human Rights Conventions. To test this hypothesis, methods of legal analysis and case studies were used, supported by bibliographic and documentary research. The research is divided into three chapters, starting with the historical evolution of international criminal justice, focusing on the structure and operation of the ICC, and concluding with the rights and guarantees of the prosecuted, culminating in the analysis of the Lubanga case. The study concludes that the ICC is essential for the protection of human rights and for changing the landscape of international criminal impunity, significantly contributing to the promotion of a culture of accountability.
