Abstract: Tendo como tema o processo de urbanização e a legislação urbanística, a pesquisa estudará os municípios da Região Metropolitana da Baixada Santista com foco nos municípios não centrais. Tomando Bertioga para estudo de caso, procurar-se-á desvendar o processo de urbanização assim como a função da legislação ambiental e urbanística que historicamente orientou esse processo. A principal característica dos municípios não centrais da RMBS, onde Bertioga pontifica como local de veraneio de população de alto poder aquisitivo, tem sido o desenvolvimento moldado exclusivamente a partir do turismo de massa com base na segunda residência, fator que cria vulnerabilidades estruturais decorrentes do fato dessa modalidade turística produzir baixo efeito multiplicador sobre as economias e baixos rendimentos familiares, situações que são agravadas com a reduzida oferta de trabalho fora dos períodos de temporada. As segundas residências são fator de valorização do solo das áreas próximas às praias, que permanecem ociosas a maior parte do ano, e de afastamento da população residente, levando os segmentos mais pobres a ocupar irregularmente terrenos de terceiros ou áreas de risco e/ou preservação permanente, produzindo degradação ambiental. Desde a Constituição Federal de 1988 uma sucessão de leis ambientais de âmbito federal e estadual vem reduzindo os espaços passíveis de ocupação nos municípios litorâneos o que acaba valorizando ainda mais as áreas remanescentes, agravando a irregularidade e precarização da ocupação. Junto com esse aparato legal de proteção todos os municípios possuem planos diretores e dispositivos de ordenamento do uso e ocupação do solo os quais não conseguem dar respostas para ocupação sustentada do território. Com o estudo de Bertioga, cujo turismo está fortemente baseado no discurso da preservação dos recursos naturais e na qualidade ambiental, procura-se conhecer como se dá o descompasso entre a legislação ambiental e urbanística e sua aplicação para o desenvolvimento sustentado do território, assim como conjeturar sobre as possibilidades de reversão desse quadro.
Abstract: With the theme of the urbanization process and the urban legislation, the research will study the municipalities of the metropolitan region of Baixada Santista with a focus on non-central municipalities. Taking Bertioga for case study, it will be sought to unravel the urbanization process as well as the function of environmental and urbanistic legislation that has historically guided this process. The main characteristic of the non-central municipalities of the RMBS, where Bertioga pointed out as a summer site of high-income population, has been the development molded exclusively from mass tourism based on the second residence, Factor that creates structural vulnerabilities arising from the fact that this touristic modality produces low multiplier effect on the economies and low family incomes, situations that are aggravated with the reduced supply of work outside the periods of the season. The second residences are a factor of valuing the soil of the areas near the beaches, which remain idle for most of the year, and leave the resident population, leading the poorest segments to occupy Irregularly Third-party land or areas of risk and/or permanent preservation, producing environmental degradation. With the study of Bertioga, whose tourism is strongly based on the discourse of the preservation of natural resources and environmental quality, it seeks to know how the mismatch between environmental and urbanistic legislation and its application for the development Of the Territory, as well as to consider the possibility ofs Reversal of this framework.
